1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of PromptMail ("Service," "we," "our," or "us"), which allows you to send and read emails from within ChatGPT by connecting your Gmail account. By signing in with Google, authorizing access to Gmail, or otherwise using PromptMail, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy describes how we collect, use, and protect your data and is incorporated into these Terms by reference.

2. Description of Service

PromptMail is a service that connects your Gmail account to clients such as ChatGPT (via the Model Context Protocol, or MCP) so you can send and read emails through those clients. We use Google Sign-In and the Gmail API to provide this functionality. We do not guarantee uninterrupted or error-free operation, and we may change, suspend, or discontinue features with reasonable notice where practicable.

3. Your Account and Google Authorization

To use PromptMail you must sign in with a Google account and grant PromptMail permission to read and send email on your behalf. You are responsible for maintaining the security of your Google account and for all activity that occurs through your connection to PromptMail. You may revoke PromptMail's access at any time via your Google Account permissions. Your use of Google's services is also subject to Google's Terms of Service and applicable Google API policies.

4. Acceptable Use

You agree to use PromptMail only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to send spam, phishing, malware, or otherwise harmful or illegal content.
  • Use the Service in any way that violates applicable law or the rights of others.
  • Attempt to gain unauthorized access to the Service, our systems, or any third-party accounts or data.
  • Abuse, overload, or interfere with the Service or its infrastructure.
  • Use the Service in a manner that could harm, disable, or impair the Service or other users.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.

5. Intellectual Property

PromptMail and its content, features, and functionality (excluding user content and third-party services) are owned by us or our licensors. You do not acquire any right, title, or interest in the Service except the limited right to use it in accordance with these Terms.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

8. Termination

You may stop using the Service at any time by signing out and revoking PromptMail's access in your Google Account settings. We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.

9. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If we make material changes, we will provide additional notice (e.g., on our website or by email where appropriate). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts located in California, and you consent to the personal jurisdiction of such courts.

11. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. We may assign these Terms; you may not assign them without our prior written consent.
